Do I need a will if I don't have any assets (or Kids!)?

I have heard a lot of people put off wills because they don't have any assets.  Likewise, I have heard people say that they will get a will once they start having children.  

As an attorney, I advise against this type of thinking, especially because of what it implies.  This is "firefighting" as I like to call it, because this puts off the planning until you are much busier or until there is an emergency (at which point in estate planning it is usually too late).

When you create a will, if it is done right, it plans for things to happen in the future.  Don't have any assets right now?  A good will ensures that when you do start to gain some wealth (as we all want to do) it will be properly protected.  

Similarly, even if you don't have children, a properly drafted will accounts for that potential. This is especially important because once you start having children (as those of us with children know), your priorities and available-time change completely.  If you think you don't have time to make a will now, wait until you have a 9 month old child!

If you're never going to have children, you still need a will so that you can specify what happens to your estate.  You can name siblings or other relatives, friends, or charities.  Otherwise the government decides who gets what, and your entire estate could even go to the state!
